Coalition asks Philly DA to not block justice for Mumia: Questions persist about newly-discovered files
The fight for justice and freedom for Mumia Abu-Jamal continues.

As the month of January winds down, there looms a decision that will materially affect the future of Mumia Abu Jamal, in particular, and thousands who have likewise been wrongly incarcerated in general : Pennsylvania Common Pleas Court Judge Leroy Tucker decided to allow Mumia Abu-Jamal's right to an appeal. After decades of injustices, blockages, attacks on his health, Tucker is scrutinizing the body of evidence leveled against him.
The fly in the ointment is District Attorney Larry Krasne, who has until January 27, 2019 to decide to either allow Tucker's decision to stand, or block it, thereby thwarting Mumia's first real opportunity for justice since his incarceration 37 years ago.
On Tuesday, January 15, at a press conference called by Mobilization4Mumia, comprised of local Philadelphia activists and community leaders - along with a nationwide coalition of supporters - who came together to demand that Krasner keep his campaign promise of reform and transparency, to objectively review past convictions and free those wrongfully convicted, and not block Mumia's bid for justice.
They demanded Philadelphia District Attorney Larry Krasner not stand in the way of justice for convicted journalist/activist Mumia Abu-Jamal, by not overturning the ground-breaking decision by Pennsylvania Common Pleas Court Judge Leon Tucker.
Tucker's ruling would give Abu-Jamal the right to reopen his appeal. The Tucker decision is an important ruling that could impact other prisoners whose appeals were similarly denied. This is the first time in the 37 year history of his incarceration that there has been an opening in Abu-Jamal's case.
Press conference speakers included Pam Africa, of the International Family and Friends of Mumia Abu-Jamal; Rachel Wolkenstein, co-counsel during Abu-Jamal's post-conviction appeal proceedings from 1995-1999; Paula Pebbles, National Action Network/Philadelphia Chapter; Michael Africa, Jr., son of MOVE Nine's Debbie and Michael Africa, Sr., and Sister Empress Phile Chionesu, of the Million Woman March.
Pam Africa stated, emphatically, “After almost four decades in prison suffering from cirrhosis of the liver, Hepatitis C and related ailments, years of court delays will be nothing less than a death sentence and a denial of justice for Mumia. The evidence is there! Our job is to stop the conspiracy to torture and murder Mumia. After 37 years in prison for a crime he didn’t commit, we are demanding that the charges be dismissed and he should be freed. What is happening to Mumia is happening to thousands of people in Pennsylvania’s prisons.”
In the days leading up to the January 15 press conference, over 200 community activists held a demonstration in front of DA Kasner's office, on January 5, 2019, demanding justice for Mumia. On January 7, they delivered over 4000 petitions to Krasner's office demanding he not overturn Tucker's ruling. If he appeals the groundbreaking ruling, there could be years of delay before he would be able to challenge his conviction. Abu-Jamal turns 65 on April 24, 2019.
Tucker's ruling has no doubt come as a surprise (shock) to many; as well as his decision to personally re-examine all the facts of Mumia's case to be sure that justice has been served. That said, it may well be what prompted the sudden “discovery” of previously undisclosed boxes of files labled “Mumia,” which were not included in the original body of evidence when he was first accused and tried for the shooting of Officer Daniel Faulkner. They were “discovered” in an abandoned furniture closet in the DA's office on December 28, 2018, after Tucker announced his decision.
A week later, on January 3, 2019, Assistant DA Nancy Kavanaugh then notified the courts and Mumia's attorneys of the files. But it was not until January 7, 2019 that the discovery was revealed to the public. All but one of the boxes had Abu-Jamal’s name on them and were labeled in such a way (18/29, 24/29, 29/29 etc.) to suggest that they are part of a larger set.
The group was suspicious of the recent “convenient discovery” of six boxes of files, and how it was that they had been “misplaced” for nearly 40 years. [Accident? I highly doubt it.] This surprise “discovery” comes after Judge Tucker demanded full disclosure from the DA's office. Frustrated by the lack of compliance with his orders, Tucker required that he personally review all of the Abu-Jamal files previously disclosed. It was only after his intervention that relevant material on which the new appeal was won was revealed.
Tucker has now ordered the recently uncovered files also be submitted for his review. It’s unclear whether this will have ny bearing on the January 27 deadline set for Krasner to decide whether or not to appeal Tucker’s decision.
After decades of scandal, corruption and mismanagement in the Philadelphia District Attorney’s Office, that has routinely denied justice to Abu-Jamal, as well as many other Philadelphia residents, the coalition of activists are rightfully suspicious and questioning this new “discovery.”
Mumia has always maintained his innocence, has argued in past appeals that he was framed by police; and that the prosecution had manufactured evidence against him; and had suppressed proof of his innocence, in addition to other violations of his right to due process.
In handing down his decision, Tucker further ruled that former Pennsylvania Supreme Court Justice Ronald Castille (also a former Philadelphia District Attorney, with close ties to the Philadelphia Police Department) had denied Mumia's right to fair and impartial hearings by not recusing himself from his appeals between 1998 and 2012. Yet, after his election, Krasner still appointed Castille to his 2018 Transition Team, which may portend continued bias and collusion on his part in any future .
The Coalition to Free Mumia, stemming from a wide range of backgrounds, is questioning why the boxes were suddenly “discovered” after Tucker’s decision, and want to know what’s in them. Abu-Jamal’s supporters and many others believe that the egregious practice of altering and destroying evidence, hiding witnesses and suspects, and fabricating police paperwork continues to this day.
Pam Africa asserted, “There could be nothing of importance in the boxes or there could be evidence that could free Mumia. Mumia was framed by withheld, suppressed and manufactured evidence, and supposedly lost ballistics tests. The DA’s Office is guilty of suppressing police corruption, prosecutorial misconduct and evidence of Mumia's innocence like witness recantations, exposure of false confessions, and photographic proof of crime scene tampering. The missing smoking gun evidence could be in those boxes. We want to know what’s in those files!”
Krasner ran on a platform “for justice, not just for convictions.” Now he has to decide whether or not to overturn Tucker’s decision and deny justice in this notorious case of injustice. The alleged “discovery” of these files provides a moral, if not legal, reason for Krasner to support the reinstatement of Abu-Jamal’s state appeal rights.
Many of the coalition of activists supported Krasner's election, and are now asking him to keep his promise and do the right thing.
According to Pam Africa, people can support Mumia Abu-Jamal by signing the petition: https://actionnetwork.org/petitions/krasner-do-right-by-mumia,
or contacting Krasner by email: DA_Central@phila.gov
Phone: 215-686-8000 or

GUEST ARTICLE: Brother Mumia Abu-Jamal wins Key Hepatitis Court Victory

By Gloria Dulan-Wilson

Hello All:

Every month for the past several years members of ATAC (Avenge The Ancestors Coalition) have been receiving updated reports - mostly heart rendering and aggravating - about Mumia's health and the recalcitrance on the part of the penal system in Pennsylvania to give him the proper treatment due any human being.   Letter, petitions, court hearings and appeal after appeal after appeal has been presented.  This, however,  is the first time in a long time that actual good news has been reported.  Kudos to sister PAM AFRICA and the other stalwart supporters for their tireless efforts in helping Mumia receive the attention and medical assistance he deserves.

BROTHER/FRIEND Nathan Hare POSTED THIS ON FACEBOOK - AND I'M SHARING THE GOOD NEWS HERE

Mumia Abu Jamal's condition and appearance have deteriorated as the results of having contracted Hepatitis C and the refusal on the part of the Pennsylvania State Department of Corrections to allow him to have the appropriate life saving medication and treatment required to cure him and save his life. The descriptions of the affects of this horrific disease on Mumia makes you cry.  The deliberate withhold of treatment is cruel and unusual punishment - inhumane and must be discontinued and remedied immediately, if not sooner.

Mumia Wins Key Hepatitis Court Victory
By Jeff Mackler

“It’s a Knock Out Punch,” says Mumia.

“We did something that’s never been done before,” says Pam Africa, Chair, International Concerned Family and Friends of Mumia Abu-Jamal.

On January 3, U.S. District Court Judge Robert Mariani granted innocent political prisoner Mumia Abu-Jamal's motion for a preliminary injunction ordering the Pennsylvania Department of Corrections (DOC) within 14 days to have Mumia examined by a prison doctor to determine one issue, – whether the administration of the life-saving anti-viral Hepatits C medication, sofobuvir, would do harm to Mumia. This formality is then to be followed within seven days by the administration of the very medication that Mumia has been fighting for since he filed his first lawsuit demanding treatment in May, 2015.

The Judge's order affirmed that Mumia has Hepatitis C, a life-threatening liver disease, and needs immediate treatment. The denial of such treatment, wrote Mariani, represents a violation of Mumia's rights under the U.S. Constitution's Eighth Amendment prohibiting “cruel and usual punishment." The Judge's order overturned a lower court decision on the same matter. Judge Mariani rulings were the first in U.S. history where a state's medical protocols for prisoner treatment were overruled.

Mumia was represented jointly by attorneys Bret Grote of the Abolitionist Law Center and independent attorney Robert Boyle. While the judge's decision applies only to Mumia, Boyle noted that it is bound to effect the class action lawsuits now in progress wherein some 9,000 other Pennsylvania prisoners with Hepatitis C in a class action suit filed by the Abolitionist Law Center have sought the same relief.

Boyle added that the DOC has 30 days to appeal Judge Mariani decision. Should Mariani refuse to grant a DOC request for a stay of his order for the purpose of filing an appeal to the U.S. Court of Appeals for the Third Circuit, the DOC may then proceed directly to the Third Circuit.

Boyle cautioned via a January 4 conference call presentation to some 30 key national Mumia activists that while "the law is on our side," the ongoing and dangerous progression of Mumia's illness notwithstanding, past history has demonstrated that in Mumia's case at least, the law is sometimes violated with impunity – a reference to the infamous "Mumia exception" wherein U.S. courts for decades have routinely departed from standard legal principles and practices to thwart Mumia's fundamental legal rights. A mountain of evidence of innocence in Mumia's case has been repeatedly excluded from the record by a racist criminal "justice" system intent of punishing one of the nation's most outspoken and courageous fighters for the rights of all humanity. Indeed, Mumia’s first 1982 trial was presided over by the infamous “hanging” Judge Albert Sabo, who in his antechambers prior to entering the courtroom, in the presence of another judge and a court reporter stated, “Yeah, and I’m going to help ‘em fry the n****r.” Nevertheless, optimistic as always, Mumia recorded a statement of thanks to his supporters that declared Judge Mariani's decision a "Knock Out Punch" won by all his supporters.

The DOC's formal defense of its refusal to administer Mumia the life-saving medication included its cruel, brutal and inhuman argument that should Mumia prevail the cost of his treatment as well as the treatment of some 9,000 other Pennsylvania prisoners with the same Hep C virus would be an estimated $800 million. Indeed, if the Third Circuit rules in Mumia's favor, since the latter's jurisdiction includes New Jersey and Delaware as well as Pennsylvania, the "cost" could be even higher.

Mumia's victory perhaps inadvertently exposed one of the nation's most corrupt and profitable industries, the pharmaceutical business engaged in the production and sale of medicines sold the world over. With regard to the 2013 discovery of sofobuvir, for example, the medicine that is estimated to have close to a 95 percent cure rate for Hep C patients, the wholesale acquisition cost to a hospital for the standard 12-week course of treatment for single patient is $84,000 while the estimated production cost is $68 to $136. If ever there was an example of a degenerate social system whose institutions would argue in court that $68 is too high a price to pay for a human life, the U.S. healthcare system and the nation itself would stand out in bold relief.

Nevertheless, Judge Mariani rejected Pennsylvania's financial cost arguments. His decision also provided substantial reasons why a possible DOC request for a stay of his order would be inappropriate, indicating that Hep C prisoners are in a state of constant deterioration that requires prompt treatment as opposed to a steady medical state wherein a delay would not impact their fundamental condition.

Attorney Robert Boyle, who successfully fought for and won the release of political prisoner Lynne Stewart three years ago, expressed concern that Mumia supporters continue their mobilizations aimed at winning broad support for Mumia’s immediate treatment and for his freedom in future litigation. Boyle pointed to new legal avenues now open to Mumia to seek a new trial based on a recent U.S. Supreme Court decision that challenged a death penalty verdict based on the fact that a state district attorney participated in a prisoner’s prosecution and later, after being promoted to the position of state Supreme Court justice, in deliberations regarding the prisoner’s appeal. Ironically, this U.S. Supreme Court decision concerned Judge Ronald Castillo, who was both Mumia’s prosecutor and later judge.

If the medical protocol precedent set by Judge Mariani is upheld, the result could be enormously beneficial to Hep C patients throughout the nation's racist prison-industrial complex, that ranks first in the world in the number and percentage of its population in prison and/or under the jurisdiction of the criminal "justice" system.

Mumia supporters are urged to call the phone numbers below and contact the DOC via email to demand that the Department of Corrections Secretary, John Wetzel, and the State of Pennsylvania do not appeal Judge Mariani's decision and do not further delay the administration of the life-saving anti-viral medical treatment to Mumia.

EMERGENCY RED ALERT: Prison refuses Mumia Medical Care

By Gloria Dulan-Wilson

Hello All:

Again we hear of prison brutality and inhumanity in regards to brother Mumia Abu Jamal.  I have to wonder, if they're this negligent to a brother who is publicly respected, revered and widely known, what kind of treatment are those, who are less well known, receiving?  It appears there should be some concerns about Mumia AND brothers who are incarcerated in the prison-military-industrial-complex across the country.  It's been revealed that the US has the highest number of its own citizens incarcerated for minor infractions across the country - predominantly African American males, followed by Latinos in number - for nonviolent infractions of the law.

Additionally, there are a goodly number who are there not because they're guilty, but because the perpetrator got away and the law enforcement is trying to save face and push the guilt onto the next person instead of admitting the real perpetrator is still at large - or sitting back watching the whole scene with amusement.

Or there's a grudge and no one wants to let it go.

Of course we know the most egregious is that the courts and judges benefit from private prisons who pay for every person who is incarcerated.  They're making millions off of our misery - nothing new - they've been doing it for centuries - but it is time to put a stop to it - immediately if not sooner.  With all these pardonings going on - the main person who should be pardoned is MUMIA ABU JAMAL - like yesterday.  This is all just a sham.  It was from the day he was arrested.  It's just that the police dept. has made him their iconic whipping boy, and love to see Black folks twist in the wind.  Black folks know it - and I daresay there are quite a few whites who know it as well.

But inhumane treatment in the face of illness, at the hands of medical professionals in unconscionable and definitely should not be tolerated - because over and above anything the prisons may be about, their Hippocratic Oath - Do Ye No Harm - holds them to a higher standard.  They are bound to heal him and care for him, regardless of what the warden, the police department, the judicial system say or do - and if they can't, or won't then they need to lose their licenses, step down and allow those who value the profession to do their jobs.

Demand that this be done immediately, if not sooner.

Prison refuses Mumia Medical Care

Mumia is still in medical danger. He is weak, in the infirmary, and still needs a wheelchair to come out to visits. In a phone call on Monday his voice was hesitant and lacked its usual vibrancy.

Yesterday, the PA Department of Corrections notified Mumia’s Attorney Bret Grote (of the Abolitionist Law Center) that it would:
  1. Not allow Mumia to be examined by his own doctor;
  2. Not allow Mumia to be examined by a endocrinologist (diabetes specialist);
  3. And they denied access for the doctor to communicate with prison medical staff to assist or direct Mumia’s care; and the Prison has refused to provide for regular phone calls between Mumia and his doctor. Currently, Mumia can only use the phone every other day for only 15 minutes, as the infirmary does not have phone access.
Mumia is being held in the very infirmary that caused his chronic conditions of eczema and late-onset diabetes to become life-threatening. The medical personnel on site were prevented from ordering tests when he was ill in mid-March, and are under the same prison/corporate restrictions today. One postive note, at this time Mumia is being allowed to monitor his own blood sugar multiple times a day, and he is receiving insulin. Since Mumia was hospitalized in ICU on March 30th with life threatening complications from chronic conditions we have been advocating for his treatment. We have to step up our efforts.

Take Action Now!

Demand that the Department of Corrections permit Mumia to have an examination by his doctor! Click here to call and fax the Prison and State officials and state our demands.

EMERGENCY ALERT: MUMIA ABU JAMAL IN CRISIS UPDATE MARCH 31 - APRIL 1, 2015

By Gloria Dulan-Wilson

Hello All:

This is the latest update I've received in reference to Brother Mumia Abu Jamal who was rushed to Schuylkill Medical Center on Monday, March 30, and is now allegedly in the ICU, isolated from his wife and family.

MUMIA ABU JAMAL IN ICU IN SCHUYLKILL MEDICAL CENTER

From: Matty Stardust <mattystarrdust@gmail.com>Date: Tue, Mar 31, 2015 at 8:55 AM

Subject: PRESS RELEASE: Mumia hospitalized, denied visitation
For Immediate Release: March 31, 2015

Dateline: Intensive Care Unit Schuylkill Medical Center in Pottsville, PA

For information contact:  Bret Grote - 412-654-9070

PRESS CONFERENCE AT 11AM TUESDAY MARCH 31

Mumia Abu-Jamal in Medical Crisis
- 20hrs Doctors refuse to talk to lawyers and family Vigil ICU in Schuylkill Medical Center in Pottsville, PA.

Literally after 20 hours of torture Mumia remains disappeared. His family and his lawyers have been prevented from receiving any information.

On the morning of Monday March 30th, prison officials at SCI Mahanoy say that Mumia Abu-Jamal had a "medical crisis" and was transported from the prison to the intensive care unit at the Schuylkill Medical Center, in Pottsville. PA.

Shackled to the bed, alone, and prevented from knowing that his family is close by he remains in intensive care. Prison officials and hospital officials when not spreading misinformation are denying Mumia's family access to visits, while also denying the family and his lawyers any information or records about his condition.

Mumia's family is keeping vigil in the ICU critical care visiting room.

His supporters and lawyers were at trial challenging the Revictimization Review Act aka the "Mumia Silencing Act"  in Harrisburg, PA when they received word that he had been taken to the hospital.

The Abolitionist Law Center's Bret Grote is in Pottsville and vigorously preparing legal action to gain access to his client for the family and access to his medical records so that independent doctors can intervene.

Mumia Abu-Jamal’s brother Keith Cook stated “The rules that the prisons have are very arcane. They don’t give out any information about prisoners to their families or anyone else. It’s like you have your hands tied because you don’t know how the prisoner is and you have no way of talking to him. I remember a month ago--- Phil Africa exercising in the prison, next thing they know they moved him to a hospital and didn’t tell his family where he was, and three days later he was dead.

"It’s scary.  This situation needs to change. The prison authorities need to be more humane to the families of prisoners.”

Pam Africa stated "Prison Officials are lying.  Mumia is going through torture at the hands of Department of Corrections through medical neglect.   It is clear to people that they want to kill Mumia.  They gave him the wrong medication which made his condition worse. Inmates on the inside who questioned what was happening have been subjected to direct retaliation by the superintendent.   They have been moving concerned inmates out of Mumia's unit in an effort to both bury and keep this critical information from the public."

Johanna Fernandez of the New York Campaign to Bring Mumia Home noted “Mumia has been complaining about being ill since January. If he had gotten the proper care he needed originally, he would not be in this situation. This crisis illustrates the problem of health care in American prisons as a basic human rights violation. I am personally concerned because Phil Africa of the MOVE organization was rushed to the hospital not long ago in good health and a few days later he was dead. We need to fight to defend Mumia’s life, and that of all prisoners.”

Now that you know, what are you going to do about it?

Keep prayers for Mumia; keep the phone calls up -  remember refer to WESLEY COOK - his slave name when making calls; keep the emails up; and those of you who are in the legal profession, work together to get rid of the unconsitutional "gag" order that would deprive Mumia and other innocently incarcerated people of their freedom of speech and expression.  It is unconstititional by the laws of the UNITED STATES OF AMERICA'S CONSTITUTION. Pennsylvania is in violation of the constitution.

Pray for Mumia and all who have been accused falsely and incarcerated wrongly.
